Terms of Service

1. Acceptance

By using the Vardio app, you agree to these Terms of Service.

2. Service description

Vardio is a marketplace connecting employers with workers for short-term and one-off gigs. Vardio is not an employer-of-record. We do not handle payments between employers and workers. We do not guarantee employment outcomes.

3. Accounts

• You must provide a valid phone number to create an account.
• You are responsible for all activity under your account.
• You may not create accounts for others or transfer your account.

4. Employer responsibilities

• Job postings must be accurate and comply with applicable labor laws.
• You must not post discriminatory, illegal, or misleading content.
• You are solely responsible for your relationship with workers you hire.

5. Tokens and purchases

• Tokens are purchased via Stripe on the website and via Apple In-App Purchase in the iOS app.
• Tokens are non-refundable except as required by law (see Section 6) or under Apple's refund policies.
• Tokens are used to publish and boost job postings.
• Token prices are displayed in the app before purchase.
• Vardio reserves the right to change token pricing with reasonable notice.

6. Right of Withdrawal for Consumers

• If you purchase tokens as a consumer (a natural person acting mainly outside their trade or self-employed professional activity), you have the right to withdraw within 14 days of concluding the contract, without giving reasons.
• To exercise it, a clear statement to us is sufficient: OzyCore GmbH, Kreuzberger Ring 24, 65205 Wiesbaden, or legal@vardio.de.
• If you withdraw in time, we refund all payments received without undue delay and no later than 14 days after your notice reaches us.
• For digital services, the right of withdrawal expires if you expressly consent to us starting performance before the withdrawal period ends and confirm that you thereby lose your right of withdrawal (§ 356(5) BGB). Performance starts when the tokens are credited to your account.
• Businesses acting for commercial or self-employed professional purposes (Unternehmer) have no right of withdrawal.
• For purchases made through Apple In-App Purchase in the iOS app, Apple is your contracting party; Apple's refund and withdrawal processes apply to those transactions.

7. Chat and communication

• Messages are private between employer and worker.
• You must not use chat for harassment, spam, or illegal purposes.
• Vardio may moderate or remove content that violates these terms.

8. Termination

• You may delete your account at any time.
• We may suspend or terminate accounts that violate these terms.
• Upon termination, unused tokens are forfeited.

9. Limitation of liability

Vardio is provided "as is". We are not liable for any damages arising from the use of the service, including but not limited to employment disputes, financial losses, or data loss.

10. Governing law

These terms are governed by the laws of the Federal Republic of Germany. Disputes shall be resolved in the courts of Berlin, Germany.
